Directly handle all litigation where bad faith has been alleged against the Corporation and corporation policies, procedures, and other institutional handling practices are at issue. Responsible for providing legal advice, oversight and counsel to claims personnel, other claims attorneys, product personnel, policy operations and marketing around potential extra-contractual matters and risk mitigation issues. Ensure the claims organization is in a position to identify, elevate, and abate extra-contractual exposures.
Essential Duties and Responsibilities:

Directly handle litigation where bad faith has been alleged against the corporation in a Complaint, and/or institutional bad faith discovery has been requested.
Monitor and assist claims on all matters where bad faith has been alleged in writing.
Elevate and otherwise report on all extra-contractual matters.
Mentor other team members and claims attorneys in the claims legal organization as needed
Oversee projects and training at the request of our business partners.
Provide guidance, mentoring and counseling on potential institutional bad faith matters to all business partners.
Undertake necessary legal research and provide legal direction on matters relevant to claims handling and policy operations
Develop and deploy training to all business partners at the enterprise level and at the local level where necessary on potential extra-contractual risks.
Responsible for the identification, hiring and performance management of panel counsel for defense of extra-contractual matters

J.D. (Juris Doctor) Degree or in-lieu of degree equivalent education, training and work-related experience
High degree of initiative, mature judgment and discretion
Ability to negotiate directly with plaintiff attorneys
Ability to proactively resolve conflicts and empathize with internal and external customers.
Solid knowledge of claims strategies
Solid understanding of the insurance industry
Solid understanding of the organizational relationship between the departments of an insurance company
Maintain active license as an attorney in at least one state
Willingness to travel up to 20% as requested.
Must possess effective written and verbal communication skills
Strong negotiation skills
7+ years of experience in any combination of the following areas: personal/commercial lines property, casualty insurance company and/or law firm experience focusing on personal lines insurance and/or coverage and bad faith issues
